Terms of Use

These Terms of Use (“Terms”) govern access to and use of BCRM, the WhatsApp Business CRM platform operated by Brandtimacy (“we”, “us”). By creating an account or using BCRM, a business (“Client”) and its authorized users agree to these Terms.
1. The service
BCRM connects to a Client's own WhatsApp Business number via the official WhatsApp Business Platform (Meta Cloud API) and provides a shared team inbox, AI-assisted replies, broadcast messaging, contact management, and automation tools. BCRM is software only — Clients connect and pay for their own WhatsApp Business Platform usage directly with Meta; we do not resell or mark up WhatsApp messaging.
2. Eligibility and account responsibility
A Client must be a legitimate, operating business authorized to use the phone number it connects. Clients are responsible for all activity under their account, including actions taken by staff they invite, and for keeping login credentials secure.
3. Acceptable use — WhatsApp policy compliance
Because BCRM operates on top of the WhatsApp Business Platform, Clients must comply with Meta's WhatsApp Business Policy and Commerce Policy at all times. In particular, a Client must not use BCRM to:
- Message any customer who has not opted in to receive messages from that Client, or continue messaging after receiving a STOP request;
- Send spam, unsolicited marketing, or deceptive/misleading content;
- Promote or sell weapons, drugs, tobacco, adult content, gambling, counterfeit goods, or any other category prohibited under WhatsApp's Commerce Policy;
- Send content that is illegal, defamatory, hateful, or that infringes another party's intellectual property; or
- Misclassify message templates (for example, sending marketing content under a utility or authentication template category).
We may suspend or terminate any account that violates this section or that puts our WhatsApp Tech Provider standing at risk, with or without notice, to protect the platform and other Clients.
4. AI-assisted features
Where a Client enables AI-assisted replies, responses are generated automatically based on the Client's own knowledge base and conversation context. Clients remain responsible for reviewing automation behavior and for the accuracy of information their knowledge base provides to customers.
5. Client data and content
Clients own the contact lists, message templates, and knowledge-base content they upload to BCRM. We process this data only to provide the service, as described in our Privacy Policy.
6. Subscription, billing, and plan limits
Access to BCRM is billed separately from WhatsApp Business Platform usage, which Meta bills directly to the Client. Plans include limits on agent seats, connected WhatsApp numbers, AI credits, and storage; exceeding these limits may require upgrading to a higher plan.
7. Suspension and termination
Either party may terminate an account at any time. We may suspend or terminate access immediately for violations of Section 3, non-payment, or activity that risks the security or integrity of the platform or other Clients' accounts.
8. Service availability
We work to keep BCRM available and reliable, but the service depends in part on the WhatsApp Business Platform operated by Meta, which is outside our control. We do not guarantee uninterrupted availability.
9. Limitation of liability
BCRM is provided on an “as is” basis. To the maximum extent permitted by law, Brandtimacy is not liable for indirect, incidental, or consequential damages arising from use of the platform, including message delivery failures caused by the WhatsApp Business Platform itself.
10. Changes to these Terms
We may update these Terms as BCRM evolves. Continued use of BCRM after an update constitutes acceptance of the revised Terms.
11. Governing law
These Terms are governed by the laws of Pakistan.
